DOT and Non-DOT Random Testing

Every CDL driver must be enrolled in a compliant random pool; for owner-operators, that means a consortium.

Non-DOT random programs follow the employer's written drug-free workplace policy and applicable state law, so mixed fleets can manage regulated drivers and non-regulated employees through one provider.

Key Requirements & What Employers Need to Know

Random testing is the most heavily audited element of a DOT drug and alcohol program. Selections must be unannounced, scientifically valid, and completed on time — for DOT-regulated fleets, additional requirements apply.

Annual testing rates (FMCSA) FMCSA requires random testing at a minimum annual rate of 50% of average driver positions for controlled substances and 10% for alcohol. A compliant consortium spreads selections reasonably across the calendar year.
Scientifically valid selection Selections must come from a scientifically valid method such as a computer-based random number generator. Every driver must have an equal chance in every draw — hand-picking or rotating drivers is a violation.
Unannounced means unannounced Drivers cannot be told in advance. Once notified, the driver must proceed to the collection site; under goMDnow's policy, testing is completed no later than the next business day, with short extensions only for documented safety or operational reasons.
Refusal = positive Failing to report, leaving the site, or otherwise refusing a random test is treated as a violation under 49 CFR 40.191 — the driver is PROHIBITED in the Clearinghouse and must complete the Return-to-Duty process before returning to safety-sensitive work.
